Policies & disclosures.

These Terms of Use (the "Terms") govern your use of AVG APPLY.COM (the "Service"), operated by Ajo Venture Group LLC ("we," "us," or "our"), a limited liability company based in New Jersey, USA. By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.

Eligibility. You must be at least 18 years old and, if applying on behalf of a household or entity, authorized to bind that household or entity.

Accounts & accurate information. You agree to provide accurate, current, and complete information in your rental application and to keep your account credentials confidential. You are responsible for activity that occurs under your account.

Acceptable use. You must not misuse the Service. Prohibited conduct includes: unlawful use, fraud, submitting false information in an application, spam, infringing intellectual property, interfering with security (malware, probing, scraping), reverse engineering, or attempting to circumvent technical limits.

Intellectual property. The Service, its software, content, branding, and design are owned by Ajo Venture Group LLC and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service for the purpose of submitting and managing a rental application. No other rights are granted.

Service level. The Service is provided "as is" and "as available." We do not guarantee that it will be uninterrupted, error-free, or that any particular unit will remain available. To the fullest extent permitted by law, we disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

Payments — Merchant of Record disclosure. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellations, and refund mechanics are governed by Paddle's Buyer Terms in addition to these Terms.

Application fees. Application fees are described on the pricing page and shown again at checkout before payment. Application fees pay for administrative processing and, where applicable, the third-party tenant-screening report. Submitting and paying for an application does not certify, guarantee, or reserve approval, tenancy, or a hold on the property.

Suspension & termination. We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. You may stop using the Service at any time.

Liability. To the fullest extent permitted by law, Ajo Venture Group LLC's aggregate liability arising out of or relating to the Service will not exceed the amounts you paid to us in the twelve (12) months preceding the event giving rise to the claim. We exclude liability for indirect, incidental, consequential, or special damages (including lost profits, lost data, or loss of goodwill). Nothing in these Terms limits liability that cannot be limited under applicable law, including for fraud or personal injury.

Indemnity. You agree to indemnify Ajo Venture Group LLC against claims arising out of information you submit, your unlawful use of the Service, or your breach of these Terms.

Governing law. These Terms are governed by the laws of the State of New Jersey, USA, without regard to conflict-of-laws rules. The state and federal courts located in New Jersey have exclusive jurisdiction over disputes, except where applicable law provides otherwise.

Changes. We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Continued use after changes constitutes acceptance.

Controller. Ajo Venture Group LLC (trading as AVG APPLY.COM) is the data controller for personal information collected through the Service. Contact us at support@avgapply.com.

What we collect. We collect only what is necessary to review a rental application and operate the Service:

• Identity & contact: name, date of birth, email, phone, current and prior addresses.
• Application details: employment and income information, rental history, household composition, pets, move-in preferences, and other answers you provide.
• Supporting documents: government ID, pay stubs, bank statements, employment or reference letters that you upload.
• Account & security: login credentials, one-time codes, session tokens, IP address, device and browser information, and access logs used for authentication and fraud prevention.
• Communications: messages you send us and support correspondence.
• Payment metadata: we do not store card numbers. Paddle (our Merchant of Record) processes payments and shares back transaction identifiers, amount, tier, and payment status.

Sensitive information (SSN, full credit data). Sensitive tenant-screening inputs such as full Social Security number are entered directly into our third-party tenant-screening provider's secure system and are not stored on our servers.

Why we use it & legal basis.

• Provide the Service, review your application, and communicate with you about it — performance of a contract.
• Verify identity, income, rental history, and (with your authorization) obtain a consumer/tenant-screening report — performance of a contract and your consent.
• Detect and prevent fraud, secure the Service, and comply with legal obligations — legitimate interests and legal obligation.
• Improve the Service and produce aggregated, non-identifying analytics — legitimate interests.
• Send transactional email (receipts, application status, magic links, one-time codes) — performance of a contract. We do not send marketing email without opt-in.

Who we share it with.

• Landlord / property manager associated with the unit you applied to, so they can review your application.
• Tenant-screening providers (such as TransUnion SmartMove or RentPrep) to obtain consumer reports with your authorization.
• Paddle.com Market Limited, our Merchant of Record, for payment processing, billing, tax compliance, invoicing, refunds, and dispute handling. See Paddle's Privacy Notice.
• Infrastructure and email subprocessors that host our application and send transactional messages on our behalf under contract.
• Professional advisers (legal, accounting) where necessary.
• Authorities where required by law, subpoena, or to protect our rights.

We do not sell your personal information and we do not share it for cross-context behavioral advertising.

Retention. Application data and supporting documents are retained for the period required by applicable landlord-tenant, fair-housing, and financial-records law — typically no less than the statutory record-keeping period and no longer than seven (7) years from the last activity on the file — then securely deleted or anonymized. Consumer reports are retained per the provider's requirements. Payment records retained by Paddle are governed by Paddle's policies.

Your rights. Subject to applicable law, you may request access to, correction of, or deletion of your personal information; object to or restrict certain processing; and withdraw consent for processing that relies on consent. To exercise these rights, email support@avgapply.com. We will respond within the timeframe required by applicable law (generally within 30 days). If you are in the EU/UK, you also have the right to lodge a complaint with your local supervisory authority.

Security. We use industry-standard technical and organizational measures — including encryption in transit (TLS), encryption at rest for stored files, access controls, and audit logging — to protect your information. No system is completely secure; please notify us immediately if you suspect a compromise.

Cookies. We use strictly necessary cookies for authentication and session management. We do not use third-party advertising cookies. If we add analytics cookies in the future, we will update this notice and obtain consent where required.

International transfers. Our servers are located in the United States. If you are outside the US and use the Service, your information will be transferred to and processed in the US under appropriate safeguards.

Changes. We will update this notice as our practices change. Material updates will be posted here with a new effective date.

Refunds for purchases on AVG APPLY.COM are handled by our Merchant of Record, Paddle.com, in line with Paddle's Refund Policy.

30-day refund window. You may request a full refund within thirty (30) days of purchase for any reason. To request a refund, either:

• Visit paddle.net and look up your order using the email associated with the purchase, or
• Email support@avgapply.com with your order confirmation code and we will assist.

Third-party screening pass-through costs. If a third-party tenant-screening report has already been ordered and paid to the screening provider on your behalf, we reserve the right to deduct the actual pass-through cost of that report from the refund, in line with applicable law. This does not limit your right to request a refund from Paddle within the 30-day window described above.

How refunds are issued. Approved refunds are returned to the original payment method by Paddle, typically within 5–10 business days depending on your card issuer or bank.

Questions or disputes. If you have a concern about a charge, please contact us at support@avgapply.com before filing a chargeback with your bank — we can usually resolve issues faster than a bank dispute.

AVG APPLY.COM, operated by Ajo Venture Group LLC, is an equal-housing-opportunity provider. We evaluate applications consistently and without regard to race, color, religion, national origin, sex, familial status, disability, source of lawful income, or any other characteristic protected under federal, New Jersey state, or applicable local law.

As part of the full application, you authorize Ajo Venture Group LLC and its screening partners to lawfully verify identity, employment, income, rental history, credit, background, and eviction history for the purpose of evaluating your rental application.

You consent to conducting this rental application electronically, including using a typed name as your legal electronic signature and receiving legally required disclosures by email or on this site.

If an application is denied based in whole or in part on information contained in a consumer report, you will receive an adverse action notice identifying the reporting agency and your rights under the Fair Credit Reporting Act (FCRA), including your right to a free copy of the report and to dispute its accuracy.
